As such, Clanly acts as a “Service Provider” under the terms of 17 U.S.C. § 512(k)(1) of the DMCA and enjoys the protections of the "safe harbor" provisions.


Notice of Claimed Infringement

If you believe that your copyrighted work has been posted on Clanly in a way that constitutes copyright infringement, please notify our Copyright department with the following information:

  • a) Your electronic or physical signature.

  • b) Description of the copyrighted work you believe has been infringed.

  • c) The URL or other specific location on Clanly where the alleged infringing material is located.

  • d) Your address, telephone number, and email address.

  • e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  • f) A statement by you, made under penalty of perjury, that the information provided in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

DMCA Takedown Procedure

Upon receipt of a proper notice of claimed copyright infringement, Clanly will follow the procedures outlined below and in Section 512 of the DMCA:

  1. Remove or disable access to the infringing material.

  2. Notify the content provider, member, or user that the material has been removed or access to it has been disabled.

  3. Take reasonable steps to promptly notify the alleged infringer that we have removed or disabled access to the content.


DMCA Counter-Notification Procedure

If you receive a notification that material made available online by you has been removed or access to it has been disabled, you may provide a counter-notification in accordance with Section 512(g)(2) and (3) of the DMCA. Please submit the counter-notification to our designated Copyright Agent including:

  • a) Your physical or electronic signature.

  • b) A description of the material that has been removed and the original location of the material before it was removed.

  • c) A statement under penalty of perjury that you believe the material was removed or disabled as a result of mistake or misidentification.

  • d) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if you are outside of the United States, for any judicial district in which Clanly may be found, and that you will accept service of process from the person who provided notification or an agent of such person.

Upon receipt of a counter-notification containing the information as outlined above, Clanly will promptly provide the complainant with a copy of the counter-notification, and inform that person that Clanly will replace the removed material or cease disabling access to it within 10-14 business days. Clanly will replace the removed material and cease disabling access to it not less than 10, nor more than 14 business days following receipt of the counter-notification, unless our Copyright Agent first receives notice from the complainant that an action has been filed seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on Clanly’s network or system.


Modifications to Policy
